Section 54
Pension and gratuity of missing employees
(1) If an employee goes missing and is not found alive, the amount of gratuity or pension received by such an employee under section 49 or 50 shall be given to his family.
(2) Notwithstanding anything written in sub-section (1), if a person entitled to receive pension according to section 50 disappears before receiving pension, for seven years and if he disappears after starting to receive pension, the entire amount of pension to his family and after that period to his spouse for life. Half of the pension amount will be given as family pension.
(3) If the missing employee is found later, if he has not paid the gratuity as per section 49, the gratuity or the amount of pension that he will get as per section 50 will be given to him from the date he comes to claim it. However, the person who is found later shall not be entitled to claim the amount of gratuity, pension or family pension that has been paid in accordance with sub-section (1) or (2).
